Wikipedia closes book on infringing domains
Wikipedia has secured the cancellation of six infringing domain names at the World Intellectual Property Organization Arbitration and Mediation Centre in a UDRP dispute.
The domain names, which all included the Wikipedia trademark along with terms such as ‘dropstore’ and ‘persian’, were registered in bad faith to capitalise on the fame of the Wikipedia trademark.
Sole panellist Nicholas Smith said that it was “improbable that a person would register six domain names in a six-month period that all incorporate (or are a minor misspelling of) the highly distinctive Wikipedia trademark without having some awareness of [Wikipedia’s] rights”.
Smith also found that the original registrant had been using two of the domain names for commercial gain, generating revenue on a per click basis.
The registrant did not respond to Wikipedia’s contentions and Smith said there was no apparent explanation as to why someone would register these domains other than their likeness to Wikipedia. All six domains were cancelled.
