LaLiga and Telefonica sought enhanced blocking measures to counter internet users' adoption of Encrypted Client Hello.

The background to events currently underway in Spain is detailed in our earlier reports but can be summarized as follows.

Through various court orders, top Spanish football league LaLiga may issue instructions for local ISPs to block pirate streaming sites and IPTV services.

Blocking is carried out by domain, URL, IP address, or meddling with DNS entries. Those actions are based on information supplied by LaLiga each week, no scrutiny from the court required.


LaLiga and Cloudflare Collide

In an effort to mitigate the effects of blocking or benefit from other features, pirate sites using Cloudflare are less easily taken offline. That caused tempers to boil over at LaLiga and then keep boiling throughout the current two to three week crisis.

LaLiga’s general position is that since Cloudflare is in a position to make LaLiga’s life easier by tackling piracy, it has an obligation to do so. Cloudflare says that LaLiga will be treated just like other rightsholders, and given access to the same tools.

Precisely what LaLiga demanded and on what basis, remains unclear, but when Cloudflare refused to cooperate, LaLiga told ISPs to block Cloudflare IP addresses. That blocked the pirate services, but it also restricted access to Cloudflare’s customers’ websites and prevented people from visiting them.

LaLiga says that, if people have website issues, they should blame Cloudflare – while also getting ready for more because it won’t be backing down anytime soon.

Cloudflare, in turn, has now responded with legal action that asks a court to rule that LaLiga’s blocking is illegal, and then on that basis, revoke LaLiga’s authority to issue blocking instructions previously authorized by the court.


Cloudflare Statement

As a long-time advocate for the open Internet, Cloudflare provides security and reliability services that protect millions of websites from cyberattacks and strengthen the Internet’s infrastructure.

In recent weeks, LaLiga and the Spanish ISPs have wrongly attempted to address the issue of illegal streaming, on the purported basis of a recently issued ruling that would order the blocking of shared IP addresses of Cloudflare and other cloud service providers, a clumsy and ineffective approach that has prevented millions of users from accessing thousands of websites unrelated to such activities.

LaLiga obtained this ruling without addressing the cloud service providers, thereby concealing from the Court the foreseeable harm to third parties and the public interest. LaLiga’s actions pose a clear threat to the open Internet.

Cloudflare has today filed a motion to annul the ruling, seeking to establish that LaLiga’s disproportionate blocking measures are illegal.

Cloudflare routinely works with rights holders to help resolve issues such as illegal streaming, but LaLiga has left Cloudflare with no choice but to pursue this legal avenue. Rather than addressing Spanish users’ concerns about over-blocking of content, LaLiga has attempted to divert attention by making unfounded accusations against Cloudflare, while stepping up its illegal blocking practices.

Cloudflare hopes this court action will help prevent future indiscriminate blocking measures and make clear that rights holders cannot put their commercial interests before the fundamental right of millions of consumers to access an open Internet.

Cloudflare’s mention of a recent ruling is interesting for several reasons. On a fundamental level, not involving Cloudflare in a process that directly affects its ability to go about its business, was likely to cause friction sooner or later.

Second, it appears that the motivation for the ruling in question turns out to be quite unusual.


Targeting ECH

The judgment in question, dated December 18, 2024, was issued by Commercial Court No. 6 of Barcelona following legal action by LaLiga and Telefónica Audiovisual Digital (owner of broadcaster Movistar Plus+), which requested ISPs including Vodafone, MásOrange, Digi and Movistar, to block pirate sites/services.

The unusual feature of the complaint is the focus on Encrypted Client Hello, or ECH for short. As highlighted earlier, this can effectively be used to bypass site blocking.

A brief explanation of ECH and its benefits to internet users is available from Cloudflare but in short, whenever a user visits a website on Cloudflare that has ECH enabled, intermediaries (like ISPs) will be able to see the user is visiting a site using Cloudflare, but won’t be able to identify which one.

Both Cloudflare and Google are mentioned in the LaLiga/Telefonica complaint, with ECH acknowledged as a hindrance to the companies’ site-blocking measures, in a section of the decision cited below.

This protocol, initially designed as a solution to alleged breaches in the area of ​​Internet users’ privacy, currently prevents the development of blocks by domains and URLs, as it allows traffic to be encrypted, and thus blocks can be made by domains and/or URLs, as Internet access service providers (ISPs) can no longer inspect the part relating to SNI5 necessary to apply blocks, according to reports on the application of the ECH protocol issued by LLCP and the anti-piracy department of [Telefonica].

The conclusion of the technical analysis is that the actual effectiveness of domain blocking (URLs/Domains) decreases as users use browsers (Google’s Chrome) that use ECH technology. A similar case occurs with Apple’s “Private Relay” feature, introduced as part of iCloud+, focused on web traffic.

According to Bandaancha, which published sections of the decision, the above issues were presented as justification for enhanced blocking measures against 119 entities, listed alongside their domain names, ports, IP addresses, and the hosting companies used.

LaLiga obtained permission to carry out dynamic blocking against new IP addresses, domains etc, in the event countermeasures were deployed by pirate sites.

Around 35 of the services are reportedly using Cloudflare and since the blocking measures requested were not considered “contrary to the law, public order or harmful to third parties,” the order was granted.

LaLiga used that authority to block the pirate sites, by blocking Cloudflare IP address and by extension, its users in Spain.

All in all, this case highlights the tension between copyright enforcement and intermediaries such as Cloudflare. The outcome could have significant implications for how these blocking issues are addressed in the future.

Meta, however, says that it took precautions to prevent 'seeding' content. In addition, the company clarifies that there is nothing 'independently illegal' about torrenting.

meta logoOver the past two years, rightsholders of all ilks have filed lawsuits against companies that develop AI models.

Most of these cases allege that AI developers used copyrighted works to train LLMs without first obtaining authorization.

Using copyrighted content without permission can be problematic, but many AI companies cite fair use as a defense. Whether that is valid will vary from case to case. Just last week, a Delaware federal court denied a motion for summary judgment based on fair use in a case between Thomson Reuters and Ross Intelligence, reversing an earlier decision.

Mark Zuckerberg’s Meta is also defending itself against several AI copyright infringement claims related to the development of its Llama models. This includes a class-action lawsuit filed by authors including Richard Kadrey, Sarah Silverman, and Christopher Golden, who accuse Meta of using their work without permission.

Sharing Millions of Pirated Books?

Interestingly, the allegations in this case don’t stop at unauthorized use of copyrighted works. The authors alleged that Meta downloaded millions of pirated books from LibGen via BitTorrent and distributed the same content to third parties.

Sharing copyright infringing material with third-parties will certainly be difficult to characterize as fair use and the plaintiffs realized this too.

Last month, the authors filed an amended complaint which added these BitTorrent-related allegations to their existing claims. The plaintiffs pointed out that BitTorrent users typically upload content to third parties and suggest that Meta did the same here.

“Meta downloaded millions of pirated books from LibGen through the bit torrent protocol using a platform called LibTorrent. Internally, Meta acknowledged that using this protocol was legally problematic,” the third amended complaint (TAC) noted.

“By downloading through the bit torrent protocol, Meta knew it was facilitating further copyright infringement by acting as a distribution point for other users of pirated books.”

The amended complaint lists three specific claims against Meta. In addition to direct copyright infringement, the authors also accuse the company of removing copyright management information, as well as violating California’s Computer Data Access and Fraud Act (CDAFA).

‘We Took Seeding Precautions’

Meta responded to this complaint with a motion to dismiss. In a supporting reply filed on Tuesday, the company notes that the ‘torrenting’ allegations, relating to the removal of copyright information and the CDAFA violations, don’t hold up.

These claims rely on the notion that Meta seeded the files they downloaded from ‘pirate’ sources, but Meta notes that there is no evidence for this. On the contrary, Meta says it took precautions to make sure that downloaded files were not shared with others.

“Focused on ‘torrenting,’ which is a widely used protocol to download large files, Plaintiffs push a narrative that ignores evidence in their possession, including a detailed expert report, showing that Meta took precautions not to ‘seed’ any downloaded files.”

While taking precautions is not the same as preventing something entirely, Meta believes that without evidence of seeding, the court should dismiss counts II and III for now.

“Plaintiffs, thus, plead no facts to show that Meta seeded Plaintiffs’ books – a claim that Meta will address at summary judgment,” Meta notes.

‘Torrenting is not Illegal’

The torrenting element is also important for the CDAFA claim. According to Meta, this is an “anti-intrusion” statute and, since Meta downloaded data from third-parties, it didn’t intrude the plaintiffs computer systems in any way.

“Plaintiffs do not allege that Meta employed technological measures to obtain any data from Plaintiffs or that the data was subject to any access restrictions. They allege only that Meta downloaded the data from a ‘well-known online repository’ that was publicly available via torrents,” Meta writes.

Just to be clear, in a footnote Meta adds that there is nothing inherently illegal about using BitTorrent to download files.

“Contrary to Plaintiffs’ assertion, there is nothing ‘independently illegal’ about torrenting on its own. Torrenting is merely a means of enabling users to download (i.e., copy) files.”

Leeching?

The authors who filed the complaint are not convinced that Meta didn’t share anything with third parties. They previously obtained additional evidence on Meta’s torrenting activity, but whether that’s sufficient is up to the court to decide.

To complicate matters further, the authors previously noted that Meta may have shared data with others while it was ‘leeching’. That is, it may have shared data without having first obtained a full copy of the file; in other words, before they were ‘seeding’.

Whether the court will dive deeper into the BitTorrent terminology has yet to be seen, but for those who are interested in file-sharing technology, it is definitely one of the most intriguing AI copyright cases out there. ]]>

American telco Altice was sued by various parties in recent years, both directly and indirectly as the owner of ISP Optimum.

Last summer, Optimum chose to settle its lawsuit with some music industry giants, including BMG, UMG, and Capitol Records, under undisclosed terms. But that didn’t mean its legal woes were over.

In a similar yet separate lawsuit, the company is pitted against a group of almost 50 music labels, that also accused Altice of ‘mass-infringement’. Assisted by the RIAA, the music companies claimed that the ISP failed to take action against repeat infringers on the ‘Optimum’ network.

“Despite Altice’s stated policies and despite receiving tens of thousands of infringement notices concerning Plaintiffs’ works […] Altice knowingly permitted repeat infringers to continue to use its services to infringe,” the complaint read.

100 ‘Pirating’ Subscribers

The complaint was filed over a year ago and the parties are currently conducting discovery, seeking relevant evidence to support their positions. Several requests link to the RIAA, which often acts as the music industry’s anti-piracy agent.

In an order issued by a Texas federal court last week, the music companies were given the green light to obtain the personal details of 100 Altice subscribers. These accounts were previously targeted in copyright notices sent by the RIAA or a third party.

Details are scarce, but the group will likely consist of subscribers who were repeatedly warned over alleged piracy activity. The music labels could use this information to gather further evidence to support their allegations.

For example, subscriber testimony could help to strengthen the argument that the ISP failed to take effective measures against repeat infringers.

Unmask Subscribers

There’s nothing to suggest that these people will be approached with any claims directly. The names, emails, and addresses of the subscribers are marked as “highly confidential” and can only be viewed by attorneys acting for the music companies.

The subscribers will be informed about the forthcoming disclosure of their personal details and any objections will be heard by the court.

Several of the music company plaintiffs have obtained information concerning alleged pirate subscribers in similar lawsuits. Movie companies also obtained subscribers’ personal details in a similar lawsuit against Internet provider Frontier Communications.

RIAA’s Letter to BitTorrent Inc.

Subscriber details are just a fraction of the information requested by the parties during discovery. Altice, for example, will also gain access to some non-privileged documents and communications between the music companies and their anti-piracy partners, including the RIAA, OpSec, and Audible Magic.

This includes information regarding a letter the RIAA sent to the company behind the uTorrent and BitTorrent clients in 2015. In the letter, the RIAA asked BitTorrent Inc. (now Rainberry Inc.), to block copyright infringing content.

At the time, BitTorrent Inc. was actively distancing itself from anything piracy related. In its letter, the RIAA asked the company to live up to that promise by actively blocking torrent hashes in its clients.

“We are willing to establish a process to share the hashes with BitTorrent Inc. on a regular basis so that BitTorrent Inc. can use the information to deter further infringement of those files via its goods and services,” RIAA wrote at the time.

It doesn’t appear that BitTorrent Inc. took the RIAA up on its offer. While some trackers have banned ‘copyright infringing’ hashes, we have never seen evidence of torrent clients acting similarly.

After the letter was published, the issue wasn’t raised in public again. Instead, the RIAA’s members focused their efforts on Internet providers, including Altice, which brings us back to the lawsuit at hand.

The nature of information sought by Altice isn’t clear. The company previously said that if music labels are concerned about piracy, they are free to go after developers of ‘piracy’ software. While neutral torrent clients don’t fall into that category, the ISP will be interested in any related legal considerations that took place behind the scenes. ]]>

When pirate site-blocking measures have hit Cloudflare in the past, those responsible responded in various ways when news of collateral damage began to spread.

A swift and relatively silent ‘CTRL-Z response’ seemed most effective at subduing criticism, mostly because it solved the problem.

When blunders were to blame, a quick-fix while pretending to know nothing was reasonably effective too. Flat-out public denials, despite overwhelming evidence to the contrary, has rarely shown to be effective. Bald-faced denial isn’t without its merits, however.

Denial tends to show that while blocking still took place, those responsible prefer not to be associated with the collateral damage making the headlines. In the grand scheme of things, only a tiny minority care about pirate sites being blocked because, in the grand scheme of things, only a small minority of people are pirates.

When paying customers end up paying the price, site-blocking successes are no match for widespread feelings of injustice.


Viva España

In Spain, LaLiga has torn up the metaphorical site-blocking etiquette rule book and challenged Cloudflare to a public fistfight instead. By admitting last weekend that it deliberately blocked Cloudflare to block a webpage run by a piracy app, and by extension many innocent websites and countless internet users, LaLiga publicly owned its actions and sailed into unchartered waters.

Paraphrasing Cloudflare, LaLiga blocked Cloudflare to get at piracy app Duckvision because it believes it has authority from a local court to do so. Having weighed its interests against those of pirates, Cloudflare, and all internet users in Spain, LaLiga’s interests came out on top.

LaLiga paints Cloudflare as an uncooperative villain who must now take responsibility for the consequences of its own inaction. And LaLiga has every right to take that position, just as Cloudflare has the right to refute the allegations.

In many parts of Spain, meanwhile, fundamental EU rights may face challenges: Article 11: Freedom of expression and information, and Article 16: Freedom to conduct a business, for example. Article 17: Right to property, which includes intellectual property, is the base upon which site-blocking measures ultimately stand, so at least everyone isn’t losing out.


Meanwhile on the Internet

So, in the all-important court of public opinion, Judge Disposable Income presiding, who will shoulder most blame for the disaster depicted in the image below?

Posted to X by a user in Spain, the image shows Uptime Kuma, a great tool easily configured to point towards most online services for the purpose of monitoring their availability. After pointing the software at a Cloudflare IP address, a series of successful ‘pings’ build to create the horizontal green line seen in the middle, with a history of what went before displayed in the chart at the bottom.

The huge block of red sits in a space where there was no connectivity for the user, at a time when a LaLiga match was airing on live TV. Cloudflare wasn’t offline, local ISPs were responsible for blocking Cloudflare under instruction from LaLiga. In a statement issued last weekend, LaLiga vowed that blocking Cloudflare would continue.

LaLiga Makes Good On its Word

A new statement from LaLiga celebrates the successful blocking of two additional pirate IPTV services, DazcFutbolios and RBTV77, both of which reportedly used Cloudflare as a “digital shield” to stay online.

“In its ongoing commitment to protecting intellectual property rights, LALIGA has successfully blocked illegal broadcasts from the DazcFutbolios and RBTV77 platforms this weekend,” LaLiga’s statement reads.

“These illegal platforms, which allowed the unauthorized transmission of football matches, operated both on the Web and in Apps, and used Cloudflare’s infrastructure and resources to hide their criminal activity alongside legitimate domains, which are used as a digital shield, in order to try to evade security controls. Between them, they account for more than 400,000 unique monthly users in Spain.”


Addressing Public Concerns

From a business perspective, LaLiga’s recent statements address most of the key talking points underpinning the current controversy. The league says it obtained authority from a court but also understood that cooperation from Cloudflare would make a difficult job a lot easier.

As a result, Cloudflare was given every opportunity to cooperate but refused to do so, LaLiga notes, leaving it with no other choice or than to block Cloudflare in order to block the IPTV providers. Any suggestion of reckless behavior is incorrect, LaLiga adds.


“These blocks, which are neither massive nor indiscriminate as LALIGA has previously stated, have also disabled a series of IPs specifically identified as hosting pirate services and unauthorized streaming services that operated in parallel,” the statements adds.


No Backing Down, But at Any Cost?

In disputes of this magnitude, the devil can often be found in the detail. Before LaLiga obtained the court order, it knew that Cloudflare is generally opposed to blocking; hardly a revelation for a company with a mission to improve online connectivity. In the knowledge that collateral damage was inevitable, LaLiga had a choice too. Having made that choice, Cloudflare is framed as the party responsible for the collateral damage, despite the power to avoid that ultimately belonging to LaLiga.

Describing the blocks as neither massive nor indiscriminate is completely accurate, at least without context. The image to the right shows that LaLiga carefully selected its targets by blocking not one but several IP addresses, each with an unknown number of innocent sites behind them, in addition to the intended targets.

LaLiga wasn’t indiscriminate when it selected the IP addresses, nor did it block a massive number of them. That simply isn’t required; Cloudflare services a huge number of important websites in Spain using relatively few IP addresses.


No Peacemakers Available

Given that this dispute looks set to continue and backing down has been ruled out, the question of intervention raises its head and who might be responsible for preventing a potential national disaster. If malicious hackers had caused a similar loss in connectivity, Spain’s Ministry of Communications would be a logical choice. Thus far, we’re unaware of any action, or indeed any interest from groups that may have any power to step in.

Historically, ISPs have ensured that blocking orders “do no harm” in their quest to block pirate sites. The mechanism in Spain is unclear but at least thus far, the ISPs involved are informing the public they’re not to blame and are simply obeying orders.

Of course, attending court to negotiate the terms of blocking is always part of the process, just as it is for Cloudflare now, LaLiga insists. The truth is, choices are available in every direction but the only ones suitable for consideration put Spain’s internet users first.
