PHILADELPHIA – The owner of adult motion pictures alleges an unknown BitTorrent user illegally distributed its movies online.
Strike 3 Holdings LLC filed a complaint on Nov. 17 in the U.S. District Court for the Eastern District of Pennsylvania against John Doe subscriber assigned IP address 71.185.35.108 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it was damaged from having its motion pictures copied and distributed without its authority. It alleges it used geolocation technology to track the defendant's IP address to the court's district.
The plaintiff holds John Doe subscriber assigned IP address 71.185.35.108 responsible because the defendant allegedly used BitTorrent file distribution network to make unauthorized copies of 40 of plaintiff's motion pictures and distribute them using the same application.
The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to permanently delete all digital medial files relating to plaintiff's works, order the defendant to remove infringing copies of plaintiff's work, statutory damages, court costs and any further relief this court grants. It is represented by Christian Moffitt and Andrew W. Bonekemper of Fox Rothschild LLP in Blue Bell.
