A second actor has sued the search engine over a movie trailer called Innocence of Muslims. The latter is known for mocking the Prophet Mohammad and leading to riots two years ago – 6 months after an American appeals court ruled for another actor and ordered the movie taken off YouTube.

According to Gaylord Flynn, the actor has received death threats and fears for his life. At the same time, Google continues providing its users with access to the movie via pirated content portals known as torrent trackers. This is what his lawsuit, filed in a California federal court, says.

Gaylord Flynn is also suing the movie-maker, Nakoula Basseley Nakoula, while saying that the search giant had refused to block access to the film, even after a 9th US circuit court of appeals panel ordered it taken off YouTube 18 months ago. Back then, actor Cindy Lee Garcia sued Google for an injunction, claiming that she owned the copyright of her performance. The first actor also admitted to receive death threats.

In response, Google argued that an injunction amounted to restricting speech, which would violate the US constitution. Now the search giant is demanding a rehearing from the full appeals court.

Innocence of Muslims is a movie that depicts Mohammad as a sexual deviant and a fool. This film sparked waves of anti-US unrest two years ago in a number of Muslim countries, including Egypt, Libya and others. This also coincided with an attack on US diplomatic facilities in Benghazi which killed 4 Americans, including the US ambassador to Libya.

Gaylord Flynn also confirmed that the movie-maker concealed the true nature of his production. The actors thought they were hired for a film called Desert Warrior, and they never consented to be in a religiously oriented movie, nor in the movie propagating hate speech.

Neither Gaylord Flynn nor Cindy Lee Garcia signed a release and their own copyright interests remain intact, according to the complaints.
